Where To Get Florida Forms DR-312 and DR-313 To Show No Estate Tax Liability

Did you know that no Florida estate tax is due if the person died on or after January 1, 2005? Seriously. For estates of Decedents who died on or after January 1, 2005, a federal change eliminated the Florida estate tax. To prove evidence of no liability for Florida estate tax and remove the estate tax lien, representatives must fill out either Florida Forms DR-312 or Dr-313. They’re very simple forms.

If the estate is not required to IRS Form 706 or Form 706-NA, then the personal representative can file the Affidavit of No Florida Estate Tax Due (Florida Form DR-312) in order to release the Florida estate tax lien. Yet, if the estate is actually required to file one of these IRS Forms, the personal representative might need to file the Affidavit of No Florida Estate Tax Due When Federal Return is Required (Florida Form DR-313) in order to release the Florida estate tax lien. For copies of the forms, just follow the links in this paragraph. As a personal representative, you can use Florida Forms DR-312 and DR-313 as evidence of no liability for Florida estate tax.

File Florida Forms DR-312 and DR-313 with the clerk of the court in the county where the property is found.
